AGREEMENT, between Guntopia.com, Inc. (hereinafter called "Guntopia") and the accepting party (hereinafter called "Contractor"). Now, therefore, the parties hereto agree as follows:
RELATIONSHIP BETWEEN PARTIES. The Contractor is an Independent Contractor to Guntopia.
TERM AND TERMINATION. Either party may terminate this relationship at any time without prior notice.
SCOPE OF RELATIONSHIP. Contractor will lawfully transfer firearms for Guntopia members.
DUTIES. Lawfully handle firearm transfers in accordance with all regulations and laws. Contractor will perform the following for Guntopia members who have selected Secure Payment Handling:
Identification. Verify the identity of the purchaser picking up the firearm by confirming their government issued photo I.D. (driver's license) with the name, and street address, as listed in the email sent to the Contractor. The Contractor will receive this delivery email alert whenever a firearm is sold (Secure Payment Handling) and they have been selected to handle the transfer. This will help prevent "straw transfers".
Inspection. Allow the purchaser to inspect the firearm. If there is a problem, Contractor will hold firearm in safekeeping for Guntopia to resolve.
Lawful Transfer. To properly record and transfer the firearm from the time of its arrival.
Notification. Only on Secure Payment Handling transactions, the Contractor will fax or go online to complete the delivery form.
CONSIGNMENT OF FIREARMS. Firearms received from Guntopia members shall be treated as on a consignment basis. As such, ownership and title of the firearm resides with the shipper, or Guntopia (in the case of a forfeited firearm or where the seller has been paid for the sale) and Contractor shall handle the firearm(s) with care and be responsible for its safekeeping from the time of its arrival. Should shipping of the firearm be required, the Contractor shall use United States Postal Service and be reimbursed (or pre-paid) for any shipping and packaging expenses by Guntopia.
COMPENSATION. Contractor shall collect a transfer fee, which was inputted during the registration process.
INDEMNIFICATION AND HOLD HARMLESS. The Contractor and Guntopia agrees hereby to indemnify and hold harmless one another and its subsidiaries, affiliates, officers, directors, agents, and employees, vendors, and suppliers from any and all claims, which may arise from third party claims.
PROFESSIONAL RESPONSIBILITY. Contractor shall have the right to refuse to transfer any firearm where the Contractor believes such transfer would be in violation of any law or regulations. Contractor will dispose of the said firearm as outlined in the Consignment of Firearms paragraph.
ARBITRATION. Any controversy or claim arising out of or relating to this Agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association in Oakland County, Michigan, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. This Agreement shall be construed in accordance with the laws of the State of Michigan and shall constitute the entire Agreement between the parties.
CHANGES IN POLICY. In an effort to provide the best customer service to our members, Guntopia reserves the right to make changes, and upgrades to the FFLdealerNet™ Network rules and policies without prior notice. Contractors will be notified within 24 hour of any material changes. By clicking the "I accept" button at that time, then any changes to this policy shall be deemed an extension to this agreement and no written signatures shall be required.
